Of all the things to consider when planning home security, perhaps the most important are the legal issues. Various laws concerning security companies, gun ownership and privacy all need to be examined before implementing a plan.

According to the Fourth Amendment to the U.S. Constitution:

'The right of the people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures, shall not be violated...'

Obviously, criminals do not abide by this or any other laws. We, on the other hand, need to uphold these laws, or we are no better than the ones who try to break into our homes. Great care should be taken since it is possible to unknowingly violate it. An example of this is the use of video cameras. If you're not careful, you could accidentally go too far.

This amendment was put in place to protect average citizens from the government invading their privacy. It has also come to be understood that it protects anyone from anyone else. Spying on your neighbor, for example, is in violation of this.

You need to be careful when installing video equipment that it does not allow you a view into your neighbor's home. If it does, you should adjust it immediately. This can become an issue inside the home as well. Many people have video monitors in their baby's room, and that's alright, but doing the same thing in the room of a teenager might be in violation of this amendment. This can be especially tricky if you share custody of that child with a divorced spouse.

Another confusing area of the law concerns gun ownership and use. Obviously, the Second Amendment grants us the right to own firearms, but many laws have been passed that alter and restrict it. Several state and local lawmakers have changed the way this right can be exercised, even to the point of making it illegal in some areas. This is what causes this topic to be a source of such controversy.

Be sure to research any state and local regulations before considering firearms as a home or personal security option. Many may say that they shouldn't have to do such research, but that is the way things are these days. Also, check out the firearm registration rules in your area, as this is now necessary almost everywhere.

If you're serious about pursuing this option, you'll need to find out what the local ordinances say about discharging a firearm. You can still wind up in a legal bind if you point your gun at someone without firing it.

No matter who you talk to, firearm issues are usually gray areas due to the way the laws are set up. But if this is your chosen course, you better be sure of the laws in your area, and how you can expect them to be enforced.

If you're going to hire a security company, you'll need to be aware of licensing that they require in your area as opposed to what they already possess. Find out if the way they respond to alarms is in accordance with local laws. Find out as much as you can about the people that will be working for you. It's, at least partially, your responsibility to make sure that they will safely operate under the local rules and regulations.

Understanding all of the legal aspects of home and personal security in your area will help you choose the right options, and save you a lot of trouble later on.
